Si usted es usuario de la plataforma Poyntia, se aplican además la política de privacidad de la propia aplicación y el contrato de encargo del tratamiento.

Cuando prestamos el servicio a un cliente, POYNTIA, S.L. actúa como encargada del tratamiento de los documentos del cliente, conforme al contrato de encargo (art. 28 RGPD); en ese caso el responsable es el cliente. Los documentos de cada cliente se quedan en su espacio y nunca se usan para otro cliente.

Datos y finalidades

La tabla recoge cada tratamiento con su finalidad, los datos que usamos, la base jurídica (art. 6 RGPD) y el plazo de conservación. Sólo tratamos los datos necesarios para cada finalidad.

Prospección comercial entre empresas (B2B) Nombre, cargo, empresa, correo profesional u otro medio de contacto profesional y la fuente de la que proceden. Sólo datos profesionales de personas de empresas del sector (promotoras, ingenierías, fondos, despachos). Art. 6.1.f RGPD: interés legítimo en dar a conocer un servicio profesional a empresas del sector. Para los datos de contacto profesional opera la presunción del art. 19 LOPDGDD. Hasta que se oponga o, si no hay respuesta, 12 meses desde el primer mensaje. Si se opone («baja»), conservamos únicamente su correo en una lista de exclusión para no volver a escribirle.
Datos técnicos de la web Dirección IP y datos técnicos de la conexión necesarios para entregar la página. Art. 6.1.f RGPD: entregar la web y mantenerla segura. Los trata Cloudflare, como proveedor de red, durante el tiempo que necesite para esas finalidades, conforme a sus condiciones. Nosotros no usamos analítica propia ni de terceros.
Usuarios y clientes de la plataforma Los datos de cuenta y de uso descritos en la política de la aplicación, y los documentos y datos que el cliente cargue en su espacio. Cuenta: ejecución del contrato (art. 6.1.b RGPD). Documentos del cliente: tratamiento por cuenta del cliente conforme al contrato de encargo (art. 28 RGPD). Según la política de la aplicación y el contrato con el cliente.

Datos obligatorios y datos de terceros

Los campos obligatorios del formulario (nombre, empresa y correo de trabajo) son necesarios para poder responderle; sin ellos no podremos atender su solicitud. Si nos facilita datos de otra persona, asegúrese de estar autorizado a hacerlo e informe a esa persona de esta política. Le pedimos que no incluya en el mensaje datos especialmente protegidos (por ejemplo, de salud, ideología o afiliación sindical): no los necesitamos.

Interés legítimo en la prospección comercial

Hemos ponderado nuestro interés frente a sus derechos: sólo usamos datos profesionales que su empresa ya hace públicos, escribimos de forma individual y sobre su actividad, nos identificamos desde el primer mensaje, le decimos de dónde proceden sus datos y le damos una forma inmediata y gratuita de oponerse. Origen de los datos

Los datos que no nos facilita usted directamente proceden de fuentes de acceso público: la página web de su propia empresa o perfiles profesionales de acceso público. Son su nombre, cargo, empresa y un medio de contacto profesional.

Se lo indicamos en el primer mensaje que le enviamos, con la fuente concreta y la forma de oponerse, como exige el art. 14 RGPD. Si no desea recibir más mensajes, responda «baja»: no volveremos a escribirle.

Destinatarios y encargados

No vendemos ni cedemos datos personales a terceros. Sólo acceden a ellos los proveedores que prestan servicios por nuestra cuenta, que los tratan únicamente para esa finalidad (encargados del tratamiento, art. 28 RGPD) y, cuando la ley lo exija, las autoridades competentes.

Si cambiamos de proveedor o incorporamos otro que trate datos personales de esta web, actualizaremos esta tabla.

Transferencias internacionales

Cloudflare, Inc. y Google LLC son empresas de Estados Unidos, así que el uso de sus servicios puede implicar la transferencia de datos personales fuera del Espacio Económico Europeo. Para esas transferencias nos apoyamos en las cláusulas contractuales tipo de protección de datos adoptadas por la Comisión Europea (art. 46.2.c RGPD).

Puede pedirnos una copia de las garantías aplicables escribiendo a privacidad@poyntia.com. Fuera de estos proveedores, no transferimos datos personales a terceros países.

Plazos de conservación

  • Formulario de contacto: supresión automática a los 12 meses de recibirse, salvo que se inicie una relación comercial.
  • Correo y reuniones: mientras dure la conversación o la relación y, si no se concreta, hasta 12 meses desde el último contacto.
  • Prospección comercial: hasta que se oponga o, si no hay respuesta, 12 meses desde el primer mensaje.
  • Lista de exclusión: sólo su correo, durante el tiempo necesario para respetar su oposición.
  • Datos técnicos de la web: los que Cloudflare aplique como proveedor de red.

Cumplidos los plazos, suprimimos o anonimizamos los datos, salvo que una obligación legal exija conservarlos más tiempo o sean necesarios para formular, ejercer o defender reclamaciones.

Sus derechos

Puede ejercer, en los términos de los arts. 15 a 22 RGPD, los derechos siguientes:

  • Acceso (art. 15): saber si tratamos sus datos y obtener una copia e información sobre el tratamiento.
  • Rectificación (art. 16): corregir datos inexactos o añadir los que falten.
  • Supresión (art. 17): pedir que borremos sus datos cuando proceda.
  • Limitación (art. 18): pedir que suspendamos el tratamiento en los casos previstos.
  • Portabilidad (art. 20): recibir los datos que nos haya facilitado en un formato estructurado, de uso común y lectura mecánica, cuando el tratamiento se base en el contrato o en el consentimiento y se haga por medios automatizados.
  • Oposición (art. 21): oponerse en cualquier momento, por motivos relacionados con su situación particular, a un tratamiento basado en nuestro interés legítimo; dejaremos de tratar sus datos salvo que acreditemos motivos legítimos imperiosos que prevalezcan sobre sus intereses, derechos y libertades, o para formular, ejercer o defender reclamaciones.

Oposición a la prospección comercial. Puede oponerse en todo momento, sin dar motivos: basta con responder «baja» a cualquiera de nuestros mensajes o escribir a privacidad@poyntia.com. Desde ese momento sus datos dejan de tratarse para ese fin (art. 21.2 y 21.3 RGPD) y sólo conservamos su correo en una lista de exclusión para no volver a escribirle.

Si algún tratamiento futuro se basara en su consentimiento, podrá retirarlo en cualquier momento. Tampoco tomamos decisiones automatizadas sobre usted (véase la sección 11).

Cómo ejercerlos

  • Escriba a privacidad@poyntia.com indicando el derecho que desea ejercer y los datos necesarios para localizarle (por ejemplo, el correo con el que contactó). También puede escribirnos por correo postal a POYNTIA, S.L., calle Central 13, Edificio Torre Godoy, 30100 Murcia (España), a la atención de Protección de datos.
  • Si tuviéramos dudas razonables sobre su identidad, podremos pedirle información adicional para confirmarla (art. 12.6 RGPD).
  • Le responderemos en el plazo de un mes desde que recibamos su solicitud. Si fuera necesario por la complejidad o el número de solicitudes, podremos prorrogarlo otros dos meses; en ese caso se lo diremos dentro del primer mes, con los motivos (art. 12.3 RGPD).
  • Si no atendemos su solicitud, se lo comunicaremos sin dilación y, a más tardar, en un mes, con las razones y la posibilidad de reclamar y de acudir a los tribunales (art. 12.4 RGPD).
  • El ejercicio de sus derechos es gratuito. Sólo si las solicitudes fueran manifiestamente infundadas o excesivas, podríamos cobrar un canon razonable o negarnos a actuar, y nos correspondería demostrarlo (art. 12.5 RGPD).

Reclamación ante la AEPD

Si considera que el tratamiento de sus datos no se ajusta a la normativa, puede presentar una reclamación ante la Agencia Española de Protección de Datos (www.aepd.es; sede electrónica: sedeaepd.gob.es). También puede acudir a la autoridad de control del Estado miembro de su residencia habitual, de su lugar de trabajo o del lugar de la presunta infracción (art. 77.1 RGPD).

Le agradeceremos que nos escriba antes para que podamos resolverlo, pero no es un requisito previo.

Seguridad

Aplicamos medidas técnicas y organizativas proporcionadas al riesgo. En concreto:

  • La web se sirve mediante una conexión cifrada (HTTPS, TLS).
  • Los mensajes del formulario se guardan en un almacén de acceso restringido y se borran automáticamente a los 12 meses.
  • El formulario recoge sólo los datos imprescindibles y no guarda la IP ni el navegador.
  • El acceso al almacén del formulario y al correo está limitado a las personas autorizadas de POYNTIA, S.L.
  • La web no carga recursos de terceros ni herramientas de analítica.

Ningún sistema es invulnerable. Si se produjera una violación de seguridad que afectase a datos personales, actuaríamos conforme a la normativa, incluida la notificación a la autoridad de control y, cuando proceda, a las personas afectadas. Las medidas de la plataforma se describen en la política de la aplicación y en el contrato con cada cliente.

Menores

poyntia.com se dirige a profesionales y empresas, no a menores de edad, y no recogemos conscientemente datos de menores. Si cree que un menor nos ha facilitado datos, escríbanos a privacidad@poyntia.com y los suprimiremos.

Decisiones automatizadas

No tomamos decisiones basadas únicamente en el tratamiento automatizado de sus datos que produzcan efectos jurídicos sobre usted o le afecten significativamente de modo similar, ni elaboramos perfiles de las personas que visitan la web o nos escriben (art. 22 RGPD).

Cambios y versión

Podemos actualizar esta política para reflejar cambios en nuestros tratamientos, en nuestros proveedores o en la ley. Cada versión lleva su fecha y su número. Si el cambio es sustancial, lo destacaremos en la web y, cuando tengamos su contacto y proceda, se lo comunicaremos. Puede pedirnos las versiones anteriores.

Scope. This policy covers poyntia.com (the home page, Poyntia Grid and the sector pages), the contact form, email, meetings and commercial outreach. If you are a user of the Poyntia platform, the privacy policy of the application itself and the data processing agreement also apply.

When we provide the service to a customer, POYNTIA, S.L. acts as data processor for the customer's documents, under the data processing agreement (Art. 28 GDPR); in that case the customer is the controller. Each customer's documents stay in that customer's workspace and are never used for any other customer.

Data and purposes

The table lists each processing activity with its purpose, the data we use, the legal basis (Art. 6 GDPR) and the retention period. We process only the data needed for each purpose.

Required data and third-party data

The required fields of the form (name, company and work email) are necessary for us to reply; without them we cannot handle your request. If you give us another person's data, make sure you are entitled to do so and tell that person about this policy. Please do not include specially protected data (for example, health, political opinions or trade-union membership) in your message: we do not need it.

Legitimate interest in business outreach

We have weighed our interest against your rights: we only use professional data that your company already makes public, we write individually and about your activity, we identify ourselves from the first message, we tell you where your data comes from and we give you an immediate and free way to object. If you would like more information about this assessment, ask at privacidad@poyntia.com.

Where the data comes from

Data that you do not give us directly comes from publicly available sources: your own company's website or publicly accessible professional profiles. It is your name, job title, company and a professional contact channel.

We tell you in the first message we send you, naming the specific source and how to object, as Art. 14 GDPR requires. If you do not want to receive more messages, reply "baja": we will not write to you again.

Recipients and processors

We do not sell or share personal data with third parties. Only providers that act on our behalf can access it, and they process it only for that purpose (processors, Art. 28 GDPR), together with the competent authorities where the law requires it.

International transfers

Cloudflare, Inc. and Google LLC are United States companies, so using their services may involve transferring personal data outside the European Economic Area. For those transfers we rely on the standard contractual clauses for data protection adopted by the European Commission (Art. 46(2)(c) GDPR).

You can ask us for a copy of the applicable safeguards by writing to privacidad@poyntia.com. Apart from these providers, we do not transfer personal data to third countries.

Retention periods

  • Contact form: automatic deletion 12 months after receipt, unless a business relationship starts.
  • Email and meetings: while the conversation or relationship lasts and, if nothing comes of it, up to 12 months after the last contact.
  • Business outreach: until you object or, if there is no reply, 12 months from the first message.
  • Suppression list: only your email address, for as long as needed to respect your objection.
  • Website technical data: whatever Cloudflare applies as network provider.

Once the periods have elapsed we delete or anonymise the data, unless a legal obligation requires us to keep it longer or it is needed to establish, exercise or defend legal claims.

Your rights

You may exercise the following rights, as set out in Arts. 15 to 22 GDPR:

  • Access (Art. 15): to know whether we process your data and to obtain a copy and information about the processing.
  • Rectification (Art. 16): to correct inaccurate data or complete incomplete data.
  • Erasure (Art. 17): to ask us to delete your data where applicable.
  • Restriction (Art. 18): to ask us to suspend the processing in the cases provided for.
  • Portability (Art. 20): to receive the data you gave us in a structured, commonly used and machine-readable format, where the processing is based on a contract or on consent and is carried out by automated means.
  • Objection (Art. 21): to object at any time, on grounds relating to your particular situation, to processing based on our legitimate interest; we will stop processing your data unless we demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or the processing is needed for legal claims.

Objecting to commercial outreach. You can object at any time, without giving a reason: just reply "baja" to any of our messages or write to privacidad@poyntia.com. From then on your data is no longer processed for that purpose (Art. 21(2) and 21(3) GDPR) and we only keep your email address on a suppression list so that we do not write to you again.

If any future processing were based on your consent, you could withdraw it at any time. Nor do we take automated decisions about you (see section 11).

How to exercise them

  • Write to privacidad@poyntia.com stating the right you wish to exercise and the details we need to find you (for example, the email address you contacted us from). You can also write to us by post at POYNTIA, S.L., calle Central 13, Edificio Torre Godoy, 30100 Murcia (Spain), marked for the attention of Data protection.
  • If we have reasonable doubts about your identity, we may ask you for additional information to confirm it (Art. 12(6) GDPR).
  • We will reply within one month of receiving your request. Where necessary, given the complexity and number of requests, we may extend that period by two further months; if so, we will tell you within the first month, with the reasons (Art. 12(3) GDPR).
  • If we do not act on your request, we will tell you without delay and at the latest within one month, with the reasons and the possibility of lodging a complaint and seeking a judicial remedy (Art. 12(4) GDPR).
  • Exercising your rights is free of charge. Only if requests were manifestly unfounded or excessive could we charge a reasonable fee or refuse to act, and it would be for us to show that (Art. 12(5) GDPR).

Complaints to the AEPD

If you consider that the processing of your data does not comply with the rules, you may lodge a complaint with the Spanish Data Protection Agency (AEPD) (www.aepd.es; electronic office: sedeaepd.gob.es). You may also go to the supervisory authority of the Member State of your habitual residence, place of work or place of the alleged infringement (Art. 77(1) GDPR).

We would appreciate it if you wrote to us first so that we can resolve the matter, but it is not a precondition.

Security

We apply technical and organisational measures appropriate to the risk. Specifically:

  • The website is served over an encrypted connection (HTTPS, TLS).
  • The form messages are kept in a restricted-access store and are deleted automatically after 12 months.
  • The form collects only the data that is strictly necessary and does not store your IP address or browser.
  • Access to the form store and to email is limited to authorised people at POYNTIA, S.L.
  • The website loads no third-party resources and no analytics tools.

No system is invulnerable. If a security breach affecting personal data occurred, we would act as the rules require, including notifying the supervisory authority and, where appropriate, the people affected. The platform's measures are described in the application's policy and in the contract with each customer.

Children

poyntia.com is aimed at professionals and companies, not at minors, and we do not knowingly collect data from minors. If you believe a minor has given us data, write to privacidad@poyntia.com and we will delete it.

Automated decisions

We do not take decisions based solely on automated processing of your data that produce legal effects concerning you or similarly significantly affect you, and we do not profile the people who visit the website or write to us (Art. 22 GDPR).

Changes and version

We may update this policy to reflect changes in our processing, our providers or the law. Each version carries its date and number. If a change is material, we will highlight it on the website and, where we have your contact details and it is appropriate, tell you directly. You can ask us for earlier versions.
